This policy outlines our procedures for addressing alleged copyright infringement under the Digital Millennium Copyright Act (“DMCA”).
Reporting Copyright Infringement (DMCA Takedown Notice)
If you believe your copyrighted work has been copied and made accessible through Lux Design Center in a way that constitutes copyright infringement, you may submit a written notice. This notice must contain the following information, as required by the DMCA:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Lux Design Center to locate the material.
- Information reasonably sufficient to permit Lux Design Center to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification Procedure
If your content was removed due to a copyright infringement claim, you have the option to file a counter-notification. This allows you to dispute the claim of infringement. A counter-notification must be a written communication and include the following elements:
- A physical or electronic signature of the subscriber.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- The subscriber’s name, address, and telephone number.
- A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located. If the subscriber’s address is outside of the United States, the subscriber consents to any judicial district in which luxdesigncenter.com may be found. The subscriber must also accept service of process from the person who provided the original DMCA notification.
Upon receiving a valid counter-notification, we will promptly forward a copy to the complaining party. Unless the complaining party files an action seeking a court order against the subscriber, the removed material may be replaced or access restored within 10 to 14 business days. This occurs at Lux Design Center’s discretion.

Repeat Infringer Policy
Lux Design Center maintains a policy of terminating user accounts of repeat infringers. Users found to repeatedly post or transmit infringing content will have their access to our services revoked. We take copyright compliance seriously to protect creators and maintain the integrity of our content on luxury and design topics.
